1. Introduction Welcome to www.ImagineThat.icu, operated by the Imagine That Design Team ("we," "us," or "our"). These Terms of Service ("Terms") govern your use of our website and services. By accessing or using our services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use our services.

2. Service Description ImagineThat.icu provides an online platform offering a suite of creative marketing and advertising solutions. Our primary service is the sale of creative image ads, short-form video ads, and local ad display advertising for a one-time fee as specified on our website. We also offer advanced digital services, such as chat widgets and an AI phone agent. Our platform also features a separate, optional bonus referral program for members.

3. Eligibility and Accounts To use our services, you must be a U.S. citizen at least 18 years old and capable of forming a binding contract. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

4. Ad Submission and Content Rules Users may submit content for their ad spots, including images and text. You are solely responsible for the content you submit. You agree not to submit any content that is:

  • Unlawful, defamatory, libelous, obscene, or sexually explicit.

  • Hateful, harassing, or discriminatory.

  • Infringes upon any third-party intellectual property rights.

  • Otherwise harmful or objectionable.

We reserve the right to review all ad content and reject or remove any ad at our sole discretion without a refund if it violates these Terms.

5. Payments and Billing The fee for one ad spot is the one-time payment specified on our website. All payments are non-refundable, except as required by law. By purchasing an ad, you agree to these payment terms.

6. Referral Program The referral program is a separate, optional benefit exclusively for our ad clients. Eligibility is tied to a single ad purchase and is not continuous.

Here is how eligibility works:

  • If you opt in, you will receive a unique referral link.

  • A payout is earned once your referral link fills a block of seven total users, which includes your referral and six new sign-ups.

  • Once the block is completed and the payout is sent, your eligibility status for that ad concludes, and you are considered ineligible to receive additional payouts from that specific ad.

  • To become eligible again, you must purchase a new ad and opt back into the program.

Payouts are processed via secure direct deposit to the bank account you provide.

7. Termination We may suspend or terminate your account and access to our services at any time, with or without cause, and without notice or liability to you, for any reason, including but not limited to your breach of these Terms.

8. Disclaimer of Warranties The services are provided "as is" and "as available" without any warranties of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the services will be uninterrupted, error-free, or secure.

9. Limitation of Liability To the fullest extent permitted by law, ImagineThat.icu and its employees, agents, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use of the services; (b) any unauthorized access to or use of our servers and/or any and all personal information stored therein; or (c) any conduct or content of any third party on the services.

10. General Provisions These Terms constitute the entire agreement between you and ImagineThat.icu regarding your use of the services. These Terms shall be governed by and construed in accordance with the laws of Randall County, Texas, USA, without regard to its conflict of law principles.
